These Terms of Use and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Cedar Pointe, LLC (“Company,” “we,” “us,” or “our”), concerning your access to and use of our website located at https://www.cedarpointehomes.com, as well as any other media form, media channel, or mobile website related or connected thereto (collectively, the “Site”). By accessing the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND MUST DISCONTINUE USE IMMEDIATELY.
Unless otherwise indicated, the Site and all content therein—including architectural designs, floor plans, specifications, 3D renderings, text, photographs, videos, and logos (collectively, the “Content”)—are owned by or licensed to Cedar Pointe, LLC and are protected by applicable copyright, trademark, and other intellectual property laws. Limited License: You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial informational purposes only. Restrictions: You may not copy, reproduce, distribute, display, modify, or create derivative works of the Content; use any automated means (including bots, scrapers, or scripts) to access or extract data from the Site; or use our architectural designs, floor plans, or renderings with another builder or for any commercial purpose without our prior written consent.
By using the Site, you represent and warrant that all information you submit (including via lead forms or email inquiries) is true and accurate; you have the legal capacity to agree to these Terms; you will not access the Site through automated or non-human means; and your use of the Site complies with all applicable laws and regulations.
All Content on the Site is provided for informational and marketing purposes only and does not constitute a representation, warranty, or binding offer to sell, construct, or modify a home. Any binding relationship with Cedar Pointe, LLC arises solely from a fully executed written Residential Construction Agreement. Prices, features, specifications, square footage, lot availability, timelines, and community details are subject to change without notice. Renderings, photographs, and floor plans may depict optional upgrades or features not included in standard offerings. You agree not to rely solely on the Site when making any purchasing or construction-related decisions. Nothing on the Site constitutes legal, financial, real estate, or professional advice.
We reserve the right to modify, suspend, or discontinue any portion of the Site at any time without notice. The Site is provided on an “as available” basis, and we do not guarantee uninterrupted access or error-free operation. You agree that we shall not be liable for any loss, damage, or inconvenience resulting from your inability to access or use the Site.
The Site may contain links to third-party websites or services (including, without limitation, real estate broker sites, MLS services, or virtual tour providers). We do not control or endorse such third-party content and are not responsible for its accuracy or availability. Accessing third-party websites is done at your own risk.
AS PERMITTED BY LAW, THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by Utah law, Cedar Pointe, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of the Site, and our total liability for any claim arising out of or relating to the Site shall not exceed $100. We assume no responsibility for errors or inaccuracies in Site content; personal injury or property damage resulting from your use of the Site or visits to model homes; or viruses or harmful components transmitted through the Site.
Visitors to model homes, job sites, or construction areas acknowledge that such locations may present inherent risks. To the maximum extent permitted by Utah law, you voluntarily assume the risks associated with visiting such sites and agree to comply with all posted warnings, safety instructions, and staff directions. Nothing in this section is intended to waive liability for gross negligence or willful misconduct where prohibited by law.
These Terms remain in effect while you use the Site. We reserve the right, in our sole discretion, to restrict or terminate your access to the Site at any time, without notice or liability.
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any legal action arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Washington County, Utah.

Cedar Pointe, LLC supports the principles of the Federal Fair Housing Act and does not discriminate on the basis of race, color, religion, sex, disability, familial status, or national origin. All real estate information on the Site is subject to change and applicable fair housing laws.
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
